Because it makes them S P E C I A L. You can transmog the legendary to look like other gear, what you can't do is transmog another piece of gear to look like the legendary (only applies to SL legos). I think he meant transmog to the appearance not from. We can transmog legendaries, just not the current ones.

White and Gray Transmoggable Items

5 is allowing Gray and White items to be transmogged! With this, many previously unavailable appearances (and some more easily obtainable) have become available for players.
